Open Records Requests

Texas Government Code: Under §552.201(a), (b) of the Texas Government Code, the office of the County Judge is responsible for the processing of requests for records in Brazos County except for those records created or received in the offices of elected County officials of Brazos County.


How to Submit an Open Records Request

Not all Open Records Requests should be filed directly with the County Judge’s Office, and the process may be slightly different for the offices of other elected officials. Here’s who to contact, and how to submit an Open Records Request for various record types:

Judicial (or court) records of all types are typically open records, but do not fall under the guidelines of the Texas Public Information Act.

District Clerk

  • Misdemeanor cases
  • Felony cases
  • Divorces
  • Expunctions
  • Child custody
  • Juvenile cases

County Clerk

  • Birth / Death certificates
  • Marriage licenses
  • Probate and civil filings
  • Real estate / Property / Land records

Justice of the Peace

  • Small claims
  • Class C misdemeanors (traffic)
  • Evictions

Law enforcement records will need to be requested from the responding / arresting law enforcement agency. You can check the online jail records for Brazos County to help in your search for the responding / arresting law enforcement agency.  

Jail Records

If you are unable to find the records you need using the Brazos County Jail Records Search, you can submit an open records request with the Brazos County Sheriff’s Office.

These types of records are managed by the Brazos County Tax Office. You can submit an Open Records Request to the Tax Office through their online request portal, or visit the Tax Office’s website for additional assistance.

Environmental Health Records requests related to septic tanks, chemical spills, AST or UST service tanks, food service establishments, hazardous material spills, and other environmental issues are managed by the Brazos County Health District.
